Not yet, I checked the advert and they were not advertised as genuine Adidas but as I have not had this happen to me before so wasn't sure if I could still claim a refund.
If anyone can advise as to my rights please help.

I take it you paid with paypal? Lodge a claim with them.
Cheers, do I need to raise the claim with Paypal or eBay?

Just thought you all might want to read the reply I got from the ebay seller when I asked him for refund. It may make you laugh or get you annoyed.
You can see the pics these are not genuine. Me thinks a claim is on the way.
"Hi let me start off by saying ARE YOU TRYING TO PULL A FAST ONE?or is a friend of yours jealous that you got a bargain & telling you they're fake.I really don't know but im not happy with your comments,i paid a lot of money for the trainers i sent you & i do not buy, sell or deal in fake anything whatsoever. The trainers i posted to you are original,if you had any thoughts that an item might be fake then you really shouldn't be trying to buy them.Just because you got them cheap doesn't mean they are fakes.Thats the way the auction goes could have went for any money.Im sorry you think this."

Forget about talking to him just get your money back through ebay / paypal. We have a SSDB letter template for this, which counts as the expert opinion. Open a dispute then PM me if you need it.
Cheers, I have raised a complaint with eBay and listed SSDB as an expert witness. Hopefully get a reply soon.

I think i might have seen these on the bay as they are my size, if they are the ones i'm thinking of the seller has had them on there for a month or so gradually reducing the price, they did have a picture of the heels so either they didn't know they were fake or they were being extremly cocky, hope you get your money back.

Think you may be right, there is a picture of the heels so he might not have known himself. Unfortunately at the time neither did I.
Doesn't stop them being fakes tho.
