Ebay Fake Trade Sanctions -
reid - 30-06-08
Ebay have just been fined 40m Euros for not doing enough to stop fake Louis Vuitton, Christian Dior and Givenchy products. Maybe this is the sanction they need to crack down properly on all fake traders.
The interesting bit though is that a large part of the case was due to "illicit sales" of genuine products. Some of the perfumes the company's produce are only permitted to be sold through licenced dealers and as such, ebay have been banned from selling 4 brands of perfume. This sets a precedent for other companies (in france at least) to follow suit. Whether other brands will follow suit is to be seen I guess (I can easily imagine consortiums and 35ths falling under similar categories)

sadly the amount awarded 70% costs for the 18 month case
and that is going to put off a lot of manufacturers from stepping up
also Ebay have lodged an appeal already and that could take another year to be heard and ruled on
i think ebay might win this one as LVMH made the case more about devaluing their products rather than about faking their products
LVMH were being snobs about it which won't help them
i think all manufacturers hate ebay at heart as it has ended their control of the brands in the retail market
what adidas/nike/apple and all the other manufacturers should have done is got together and done this
gone up against them with a unified front and combined industry weight/funds
ebay are too big to mess with alone
grrr...
i hate ebay soooooooooo much

and...
imagine if ebay were not allowed to sell consortiums or limited runs of shoes
hate to say it but most of us would struggle to ever track down a pair of anything rare without the use of ebay
i spoke with someone at nike last year and they said they love the hype they get from dunks going for $2,000
but hate the fact that they get no more than their cut of the original store price
they had even considered selling the shoes at $800+ to control what happens with them but said the backlash would be too great
i read that every company since 2003 that nike have taken to court for manufacturing counterfeit goods has liquidated before nike see a penny of money awarded
there is zero incentive for them to go after ghosts
