I'd guess that the seller is acting against eBay rules, unless he's selling a chance to own the shoes? (even that is probably against their rules)

If not, then the winner of the earlier ending auction should win the shoes regardless, but unfortunately eBay cant enforce people to actually send item they have sold - as I'm sure a lot of people on here have experienced.

Conclusion - it's naughty but he'll probably get away with it Confused

Yeah good point, it will be a fair bit on these and I doubt the 'losing' winner would agree to mutually cancel the transaction?

Absolutely.
The losing winner should completely disagree with any shit he ends up filing and he will end up having to pay fees on the final value.
You can't sell chances cos then you are effectively running a lottery which opens up a whole new can of worms.
I listed 10,000 tickets on Ebay with the guarantee of a £10,000 ring to the lucky ticket holder.
Ebay shut me down in 3 days.
